Legal Question in Criminal Law in Florida
I am not sure if I am asking the question in the right section, but here it goes. I live in a gated community with security and cameras 24/7. Lat week my car was stolen from right in front of my house and the funny thing is the car was not running the motor did not run, so it had to be pushed or most likely towed. I made a police report and asked the supervisor for a copy of the video because if the car was towed out of the community it has to be on video. He first agreed, but I've been by already a few times and he always has a different story not to give me the video. I called the association and tried to speak to the manager in charged of the community and every time I left a message with the receptionist about what happened and that whoever took the car has to be on camera and it's been over a week and no one has responded. I also spoke to the detective in charge of the case and he said all he could do is call and request a copy of the video and see if they would provide it and this is been more than a week already and nothing yet. I am so upset and feel so hopeless because no one is doing anything and the car didn't just disappear. I want to know if a lawyer would be able to help me in any way? or if I can open a lawsuit case? I just don't know what to do at this moment because I feel that they are trying to hide something. The video could easily show a tow truck towing the car out. Thanks for the help
1 Answer from Attorneys
You may have to file a civil suit and/or an injunction to preserve the evidence. A criminal lawyer is probably not going to be able to help you here, so you should contact a local attorney to see if they can help you with the civil portion of the case. In the meantime, you should press the police to see if they can subpoena the community association to get you a copy of the video.
