Legal Question in Criminal Law in Florida
I have two questions both do not pertain to an actual case so a yes/ no answer will be sufficient.
1. During a normal traffic stop with police they notice you have a pill container. This container is a real prescription that is yours and is current. It happens to be a medication that the officer isn't familiar with. Are officers legally allowed to question you about your prescribed medication? And this medication doesn't have any relavence to the traffic stop such as a DUI.
2. Is there any questions that you are required to answer by law or can you request the presence of an attorney for everything?
1 Answer from Attorneys
1. Yes, officers are allowed to ask, but you aren't required to answer.
2. Yes, biographical questions must be answered, for example, and yes, you can always ask for an attorney, but that doesn't mean you get one right then and there.
