Neither of us were here they gained access to our home under rather auspicious terms, but that is not here or there. They located my wife at her parents and she said she wanted no assistance. At 3 am they came to our home banging on the windows and door for me. What was my rights.

I am confused. Were you actually placed under arrest. In general they can not arrest you unless there is at least an allegation of some contact between the two of you. If you are a suspect, you are under no obligation to speak with the police and you are under no obligation to let them into your home without a warrant.
