Legal Question in Criminal Law in Florida

I recently attempted to steal a couple video games out of a Walmart and got caught then was charged with a misdemeanor. It wasnt something I planned. I was peer pressured and I knew it was wrong and that I shouldn't have done it. This is my first offense, I have never been in any kind of trouble with the law until this day. I won't go to jail, right? I just want to pay all the fines and I'm willing to do community service or whatever. Just anything but jail. I am 18 years old.

There is a law for first time offenders such as yourself, however, it does require the consent of the prosecutor. A misdemeanor diversion, aka, pretrial intervention, allows you to do some probation-like program where you do things such as community service and some costs, and upon completion, charges will be dismissed. It would be best however, to get an attorney to help convince the prosecutor to get you in the program. Furthermore, your attorney can review other options with your attorney including defenses to the charges.

It would be worthwhile to speak to an attorney. A theft charge is something you do not want on your record especially at such a young age. It may affect future employment and educational opportunities. Also, if found guilty, your driver's license will be suspended for up to 6 months.

An attorney can review your defenses (if any) or at the very least negotiate with the State for a lenient disposition such as a diversion program.
