Legal Question in Criminal Law in Florida

Recently a friend and myself were at a bar and a local woman invited us home with her. She invited us into her condo and to come upstairs. She later asked us to stay with her. We were all drunk but everything was consensual. She said she was single and wasnt wearing a wedding ring but her husband came home shortly after we arrived at her house. He came into her room and pushed me and I landed in a chair cutting my back and hand open. We both ran out of the house and drove away. Now it is a week later and he got my friends phone number somehow and is calling him saying his wife is "remembering more and more, and they are considering pressing charges."

My question is, is there charges that could be pressed and if there is would I need to counter sue for harassment or assault?

You may want to head him off at the pass and call the cops on him. He is harrassing you. Then you can tell your story to the cops. You may want to consult a local attorney first and have him there when you talk to the cops.

What you do now really depends on what happened then, and what proof you have. You didn't indicate in your question what conduct occurred, but I can guess. Was she drunk, or was she passed out? There is a difference. Where was your "friend" at the time you were in the room with the woman you went home with? I agree with the first answer, you should talk to an attorney that does criminal defense work. The threat that is being raised is not to sue you, but to prosecute you for rape. Take it seriously. Unfortunately, you put yourself in that position, but now it is time to circle the wagons and defend yourself, whether anything criminal happened or not. As for suing the husband, what do you think a jury will say when they hear that you were in the husbands bed with his wife and he came home. I wouldn't count on collecting much money.
