Legal Question in Criminal Law in Florida
I recently made a report for extortion but I'm afrid the other party will argue that I was the one who offered money to settle the matter. I initially suggested that we settle this without going to the court with maybe a little bit of gratuity through monetary means but they ended up asking and taking $30000. Is it my fault for offering in the first place? Also I had to have money transferred from Korea but coincidentally someone was moving to Korea. So instead of doing a wire transfer they gave me the dollars and got the money in Korea when they got there. Is that kind of transfer illegal?
1 Answer from Attorneys
Would need a lot more facts, but as to whether it was illegal, the main thing to ask is, "did you intend to defraud, extort, steal, etc. from anybody" and if the answer is no then generally it is legal. You should talk to an attorney in person to be sure.
