In order to clear a criminal history and arrest record in Florida you must file a petition with the court in the county in which you were charged. Expungement and sealing of records is only permitted under limited circumstances. Moreover, certain crimes can never be expunged or sealed. The first step is to determine whether the client was convicted of a crime, the offense was dismissed, the client was placed in pre-trial diversion, or adjudication was withheld. The second step, if the client qualifies, is to obtain a certificate from the Florida Department of Law Enforcement stating that the client qualifies for expungement or sealing of records. The cleint then signs a petition and the attorney files the petition and the FDLE certificate with the Court. If everything is in order the petition will be granted.
