Legal Question in Criminal Law in Florida

If my record is sealed, am I legally allowed to say I have no criminal records/arrest records in the state of FLORIDA? Also, in a case where a private background check picks up my unsealed record, what do I do?

If it is sealed, the answer depends to some extent on what the application is for. A normal job you can answer No. Certain jobs like government or law enforcement will specifically tell you that you must disclose sealed records. Unfortunately the internet has changed the game quite a bit since companies capture arrest data. If a private company finds your arrest, there is very little you can do about it.

So basically the answers is: It depends on the situation.

Florida Statute 943.059 provides that a person may lawfully deny or fail to acknowledge a criminal case sealed pursuant to this chapter. There are exceptions, however, such as if the person is a candidate for employment with a criminal justice agency.
