Legal Question in Criminal Law in Florida

Record Sealed

Hello my name is Nicholas, and my legal question is am able to have my criminal record sealed under Florida Law? The details regarding my situation is as follows..... I was sentenced as an adult on juvenile charges of Burglary, Grand Theft, and Battery on a School board employee. Adjudication was withheld pending completion of a 5 year probation sentence with community hours, restitution, and court cost. The problem is.... one year into the probation I was arrested for DWLS and sentenced to 6 months county jail. This violated my Felony probation because I could not make my monthly visit resulting in me being reinstated on Felony probation with one year house arrest and 4 years probation. The judge didn't order adjudication withheld in the reinstatement sentencing and there was no new felony charges. The violation was a technical one. Am I still able to have my record sealed. Thank you for your answer.

Re: Record Sealed

Hi Nicholas if you have ever been adjudicated of any crime then you cannot seal your record. If the felony changed to and adjuducation or you were adjudicated of the DUS then you wont qualify.
