Legal Question in Criminal Law in Florida

reduction of sentance

A family member just got the appeal denied for a 30year senctance in the state of florida. I am not sure what other options we have but I was told we can submit for a reduction of sentence. How do I go about doing this? Also the entire family lives in another state than florida. If our family member has to serve the entire 30yr sentence can it be moved to the state we live in so that we can visit our family member over the next 30 years? I was told this is something called interstate compact please let me know how I can find out about both these issues?

Re: reduction of sentance

I am afraid you have gotten some wrong information. There is no motion to reduce sentence. There is a motion to mitigate sentence which must be filed 60 days after the orginal sentence. Honestly, my opinion is that even if you could file that motion there is almost no chance it would be granted, so you really haven't missed anything. A Florida state sentence is served in Florida. There is no way to move him out of state. Interstate compact has nothing to do with this. Good luck.
