Relates to alleged violation of restraining order and domestic violence

Defendant's wife allegedly falsely acused him of pointing gun at her. Was arrested but eventually released on his own recognizance. Defendant's wife, who happened to reside across the street from the Defendant, got restraining order against Defendant. Subsequently, defendant moved from the area. Wife allegedly told Defendant he could visit his children but feels he was set up because upon arrival at her house, he was again arrested, this time with no bond. What are his rights, i.e., arrest, bond issues, visitation with minor child w/RO?

It all depends on what the injunction for protection order conditions are. In Florida there are no "restraining" orders. Your defense would lie in whether the injunction allows you to have consentual contact with the children. Your best bet is to ALWAYS have someone around who can verify what the wife is telling you...
