Legal Question in Criminal Law in Florida

Representation

Is is a persons right to have legal representation? I know the answer to this question is yes. My son was arrested for criminal mischief and an assistant to the public defender came to see him and indicated that the bail was set to high for his crime and stated that his public defender is out of the office until next week and he will have to wait til he comes back to have anything done about it. Is this correct? Can they deny him proper representation because his assigned representative is out of the office? Please respond with answer.
