The petit theft over $100 but less than $300 is a First Degree Misdemeanor. The maximum punishment is one year in the county jail. The judge could do a number of things. He could reinstate probation, meaning she goes back on probation so she can finish doing the things she was supposed to do, like community service, with maybe some additional sanctions. He could revoke and terminate and only give her time served, meaning she is done and has nothing else to do. Or he could revoke and terminate probation and give her a jail sentence up to one year in jail. She definitely needs an attorney to address the VOP and negotiate a decent outcome.
