Legal Question in Criminal Law in Florida
Restitution and Court Costs-Adj Withheld
Section 19 of the Florida Constitution pertaining to costs. Does this apply to adjudication withheld ( felony ) example: I know someone on probation and the file states adjudication withheld they have to serve 2 years probation and pay court fees, officer fees etc but on top of that the court ordered restitution and combined the restitution amount with the probation fees forcing the charged individual to pay allprior to being released from probation directly to the state. If I read the statement below and simply interpret , I would say this is not legal according to the Fl Constitution and if applies to adjudication withheld. ????
