Legal Question in Criminal Law in Florida

Return of Bail

In July, 2007, I posted bail on behalf of a relative in Florida. The amount was $35,000.

He was out until October 11, 2007, at which time he was sentenced to 13 months in jail.

I would like to know:

(a) how I go about requesting that my Bail be returned to me?

(b) When is it usually returned (i.e how long is the waiting period)?

(c) Can they use the Bail to settle any Court Costs?

Thanks in advance.

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. You will need to contact the clerk of the court in the county in which the party was arrested and bail was posted. The monies should not be used to pay court costs as it was only a bond to guarantee the defendant's appearance at trial and subsequently to appear for incarceration. Bail is usually returned as soon as the case is finished or within a short time thereafter.
