returned check

I have a pre-trial conference cocnerning a return check for re-payment on a loan from a friend.

Is this a criminal offense or civil matter?

It could be either one. Pre-trial conferences are used in civil and criminal cases. You need to look at the documents requiring your attendance (Summons).

If it is civil it sounds like small claims court. from a civil standpoint you could be liable to the holder of the check for up to 3 times the face value of the check plus attorneys fees and court costs. Plus you could still face criminal charges.

If it is criminal the charges against you will be determined by the face amount of the check, and you can still be fined and ordered to pay restitution to the holder of the check.

Look at the top of the Summons. It will tell you if it is criminal or civil. If you need any further assistance call my office.
