Legal Question in Criminal Law in Florida

My fiance and I were walking in a local mall. A man of foreign decent walked between us and bumped my fiance. My fiance stated ''Watch where you're walking man.'' The man who was about 5 feet away charged toward my fiance and stated ''No, you watch where you're walking man.'' My fiance felt threatened and with both hands pushed the guy back. In the process my fiance's hand slipped off of his shoulder and caught him on the side of his face. He DID NOT hit the guy. Now they are seeking the maximum penalty of 365 days in jail. What can we do about this? My fiance is an Iraqi war vet and is diagnosed with PTSD and anxiety disorder.

He will have to tell the story to the judge and hope that his tale is convincing to the court. He may get lucky and the other party fails to cooperate with the police or come to court and the case might get dismissed. In the interim, he would be well advised to retain a good criminal attorney to represent him.
