Legal Question in Criminal Law in Florida
rights violated
My friend was arrested Sep 24th with a second degree misdemeanor but charges has never been filed against him yet, and there are no paperwork stating why he is being charged with it. Can they still hold him. it's that violating his rights. He does not appear in court again until november 7th. So he is basically sitting in jail until someone file charges against him.

He would have seen a judge within 24 hours who would have set a bond. They are not holding him if he has a bond. They can take up to 33 days.
