Legal Question in Criminal Law in Florida
My roommate gave me her ATM card and PIN number so I could go to her bank's ATM machine and withdraw $140 that she was letting me borrow. I gave her her card back that same day. Now today we got into an argument about something that has nothing to do with the money and because she is mad she said she is going to call the police and tell them I stole her ATM card. Now they do have me on camera at the ATM machine using her card and I do not deny using it but I did not steal it. She gave it to me and told me her pin number. So if the police show up at my home what do I do? Can they arrest me if she lies and says I stole it even though I did not?

Yes, they could arrest you based on her lie, but the fact is you're not guilty. Once she gave permission, then you are innocent of any wrongdoing (unless you took more than she asked and pocketed it). If the police show up, tell them you want to talk to a lawyer. Better yet, get a lawyer now.
