Legal Question in Criminal Law in Florida

Sealed Criminal Records

I was arrested in 1991 for a misdemeanor. The judge withheld adjudication. I had my record sealed in 2001.

1. Can I answer ''No'' on a job application when asked the following question, ''Have you ever been convicted of a felony or misdemeanor ? ''

Re: Sealed Criminal Records

If the judge withheld adjudication, you can answer "no" because you have not been "convicted" of that crime. That would be true regardless of whether or not you had your arrest record sealed. Having your record sealed relates to your arrest, not the ultimate disposition in court. Good luck with the job search!!
