Legal Question in Criminal Law in Florida

Sealed Records Showing Up

I was arrested for a misdemeanor in 1991... The Judge withheld adjudication... I had my record sealed in 2001...

I performed a criminal background check on myself via the internet on a couple different websites (usinfosearch & intelius) and the record that I thought was sealed is showing up.

Question 1 - Why is the record showing up if it is sealed?

Question 2 - Do employers (large corporations) typically use these type search firms or do they have to verify the accuracy of the information with the Clerk of Court?

Note: When searching on Clerk of Court or FDLE sites the record isnt showing up (Good thing).

Re: Sealed Records Showing Up

Advise the commercial background check companies that the record has been sealed, include a copy of the order, and demand that all references be withdrawn immediately. If they do not comply, hire a lawyer.
