Legal Question in Criminal Law in Florida
Sealing and/or Expungment of criminal record
I want to get my record sealed. I have been attending college and am on the path to a brighter future. I have some past issues that I am extremely interested in erasing! I got involved in drugs awhile back and made some mistakes that I truly regret. What happened was I took some money from my parents and pawned a camera of theirs. I got chaged with grand theft(3rd degree), dealing in stolen property and false information to a pawnbroker. I was placed on probation, but violated and was sentenced to florida state prison for a year and a day. While I was there, I got in no trouble at all. No write ups, whatsoever(which is very hard to do!). I have since turned my life around, haven't been in even the least bit of trouble, haven't used any drugs or alcohol at all, and have been going to college to get my associates degree. From there I would like to continue on to get my bachelors. Is there any chance of me getting this expunged or sealed from my record for future employment purposes? I can provide a letter from the ''victim''(my mother) stating that she absolutely is for this being done. Please let me know if this is possible to do, in my situation, or maybe if I need to wait a certain amount of time before attempting to do so. Thanks

Re: Sealing and/or Expungment of criminal record
You are probably not eligible for either a sealing or expungement of your arrest record. Had that arrest been your one and only arrest, and had you received probation with a "withhold of adjudication," you might have been eligible to have your record sealed. However, once you violated probation and got sentenced to prison, the Court would have had to "adjudicate" you on those charges. If so, you would be ineligible for either a sealing or expunction.
For more information on sealing and expungements, you can check out my website at: www.slavinlawfirm.com which has a whole page dedicated to just that topic.

You are not eligible for either remedy. You can reinstate your civil rights but those convictions are there for good.
