Legal Question in Criminal Law in Florida
Search warrant, items in discovery and depositions
Should a search warrant be presented and left at time of search, and should affidavit be given with items found during search or should the warrant be placed in the property upon release from jail?
When items have been ''discovered'' during a search, should everything be listed, photoed, and any marked monies circled in red?
Am I entitled to have copies of depositions?

Re: Search warrant, items in discovery and depositions
Generally a copy of a search warrant should be given to the person whose property is searched or left behind if no one is there. This is not always done and there is no remedy for it. You will not get a copy of the affidavit until after an arrest is made or discovery demanded. All items that are taken during a search for evidence should be listed on an inventory sheet and left with the warrant. Photos are not required.
