Legal Question in Criminal Law in Florida
Can I seek criminal charges against my ex and his girlfriend for custodial interference under Florida statute 787.03? My ex husband was in jail for 2 months 27 days in which he didn't tell me and told our two children not to tell me. My kids stayed with his girlfriend during this time. We do exchanges at school, so I was never aware that my ex was unavailable. Our divorce decree states that the other parent has the right superior to all third parties to care for children in the event the other parent is unavailable. Thank you.

You may have a stronger case for contempt or for modification of the current parenting plan given his deceit and him using the children to carry out his deceptive plans.
