Legal Question in Criminal Law in Florida

If someone has a seizer and was in a bad accident which a death occurred the person never had seizers before is on pain meds for other medical conditions never told he could not drive was not over dosed on meds took them for 20 years suffered a traminic brain injury from the accident cant remember anything is not the same person he was before has been in jail for a year already is there a chance of hope for him he has a public Defender whos not telling me anything
