The maximum is a year in the county jail and/or $1,000 Fine and/or 1 year of probation. It is worth knowing, if you have a prior battery conviction, your simple battery can be enhanced to a Felony Battery. Also, if this is your first battery and you are convicted of this offense... you next battery will most likely be a Felony Battery.

If you have no prior record (or a very minimal record), you may be eligible for a pretrial intervention (PTI) or domestic violence diversion program. It would be worth consulting with an experienced criminal attorney in your local area.
