Legal Question in Criminal Law in Florida
Sentence Modification
My daughter is serving 18 months in DOC for a technical VOP on a drug trafficing charge. We filed a motion for a sentence modification pro se which was denied. Is there any other type of motion that we can try to file to see if we can get the sentence lessened or changed in some kind of way? She has served 8 months of the sentence. She has also found out that she is going to have to have her kidney removed due to a large mass could this help with lessening the sentence in some way also?

Re: Sentence Modification
Sentences should be considered final when rendered. They are almost never modified. Unless DOC cannot handle her operation, I do not see any other avenues.
