Legal Question in Criminal Law in Florida
i was sentenced to probation for a crime that did not occur (through a plea) but now find myself in violation status. my question is can i now withdraw my plea and force a trial and if so what would be the proper procedure. thank you

It's too late to do anything now that you have pled. You waived your rights to any defenses you may have had by entering a plea. If you didn't do the crime, then you had the right to a trial to dispute it, which you chose not to do. Although it may be possible to withdraw your plea, all that means (if and only if the judge allows the plea withdrawal) is that you start from scratch and you go to trial. You should talk to an attorney in more detail about this to see if there is anything you can do.
