Legal Question in Criminal Law in Florida
Sentencing Guidelines for Burglary on a Dwelling
My 23 old son has been arrested for Burglary on a Dwelling. He has been convicted once of a third degree felony for cocaine. He broke into my neighbors shed and stole a small tool box and a fishing pole. He also took the gas out of his boat. My son is addicted to Crack and was stealing to support his habit. He already admitted to the police and my neighbor that he stole the stuff and why. He intends to tell the judge the same thing. He is currently being held on a $25,000 bond, and goes to court again on May 4th. Any idea how much time he will get for this and would it be possible to ask the court to help him get off the drugs?

Re: Sentencing Guidelines for Burglary on a Dwelling
The maximum penalty for Burglary on a Dwelling as you describe it is 15 years in prison. Depending on the county you live in and the judge and Assistant State Attorney handling the case, your son may be eligible for drug treatement.
In Palm Beach County, there is a "drug dorm" where inmates receive drug counseling.
