What you wrote: Can a person be for armed robbery is his fingerprint are not on the gun even after a ballistics report?
What I think you meant and what I will answer: Can a person be [charged] for armed robbery i[f] his fingerprint[s] are not on the gun even after a ballistics report? YES. THERE IS NO REQUIREMENT THAT THE STATE PROVE THAT THE DEFENDANT NOT ONLY COMMITTED THE ARMED ROBBERY BUT THAT HE ALSO LEFT FINGERPRINTS. IT WOULD DEFINITELY HELP THE STATE'S CASE BUT IT IS NOT NECESSARY.
