My problem is a 16 year old girl and her mother lyed to me about her age they told me the 16 year old was 18 and for 2 months iam thinking she 18 until the police can and touch her and told the detective that i had no ieda that she was 16 but the state press charge againts me saying the girl is 15 and she really 16 and they didnt find no evidence say that i had sex with her they arrest the cop a week later and arrest me 4 months later with lewd and lacivious behavior i dont know what do and i was 20 at the time can you please help me out and they said the girl was laughing when she tell the detective that the police officer had touch her

You are currently charged with a very serious offense that has life changing consequences such as being a registered sex offender, being a convicted felon and jail and/or prison time. There appear to be some facts that a good criminal defense attorney may be able to use to convince the State to reduce your charge and/or sentence. Unfortunately, the law regarding sex offenses is very harsh. Lewd and Lascivious Battery does not require that you know how old a girl/woman was. In fact, it is not a defense that you thought she was a different age. I've seen cases where the girl even had an ID that said she was of age. However, a good criminal defense attorney can often convince the State that filing your charge as a 2nd degree felony is not appropriate in your cases, given your age, and your relationship. Whatever you do, do not talk to detectives about your case, unless you have an attorney present.
