Legal Question in Criminal Law in Florida

I am a sexual assault nurse examiner. My question is : unconscious pt.brought to ER by local law enforcement. Local law request that a forensic exam be conducted . Is a court order required before conducting the exam. Also as a forensic nurse , it is my opinion that a medical exam be conducted in order to do a comprehensive and proper exam. I understand that Hippa protects this information and since law enforcement can not request a medical exam ? Where can I locate legal procedure for this example? Thankyou, gsreed

Dear Nurse, Lawyers don't have this kind of technical knowledge. It has to do with LICENSING of professional law inforcement, nurses, forensic examiners, etc. If you don't know what is required/allowed of you as a forensic nurse, YOU NEED TO CONTACT YOUR LICENSING BOARD AND ASK. If you are in doubt of committing malpractice, then confide only in your attorney with the protection of the attorney client privilege.
