sexual battery on a child over 12

my boyfriend was taken to jail on a sexual battery charge for my son. my son knew that this was an accident and does not want him to go to jail. my son slept in my bed one night and my boyfriend rolled over in his sleep and pulled him over to him and touched him the same way he does me when i am in the bed. my son told my friend that he thinks my boyfriend thought he was me when he slept with him. my friend called the cops and they arrested my boyfriend. my son and i do not want to press charges but the state does. what can we do. My son is devistated by this because he loves my boyfriend more than he does his biological father and he has been in our lives for 6 years. he is not a child molester and now we have to prove it. it was a mistake and we know that but the state wants to make it more. please advise us what to do. thank you J

You certainly have a case that you need to defend to the best of your ability. The consequenses of this case can result in a life sentence, or a min. of 30 years. PLEASE try and get the best criminal law attorney you can possibly afford. But, if you cannot afford the best USE the public defender that is appointed to you. The PD's office is very, very skilled in handling these cases because they see a lot of them. Of course the drawback with a PD is that they are VERY busy. BUT do not shop for your defense counsel the way you would shop for discount items in a large department store. You probably know that generally you get what you pay for. Unfortunately your case is SO important that I cannot tell you much on a web site. Yuor best bet is to speak to an attorney in person...GOOD LUCK.
