Legal Question in Criminal Law in Florida

sexual consent of a minor

Dear whom it may concern,

I hope you can help me. I've looked up many different sites and they always seem to contridict eachother. In most sites I read it states sex is legal at the age of 16 aslong as it is consentual and the other person involved is 23 years of age or younger. However in other sites i've read that the age is 18 period. Now you see where my confusion comes in. Also I've read about parental consent under the age of 18. In conclusion i hope to hear from you soon and i hope you can clear up some of my confusion. Thankyou

Re: sexual consent of a minor

I have been asked this question before and consulted with Florida prosecutors and still can't a clear answer. I would say anyone under the age of 18 cannot give consent to have sex. There may be some exceptions, but I wouldnt risk it.

Re: sexual consent of a minor

The short answer is simply that each person should be at least 18 y/o regardless of the other person's age. The florida statutes dealing with the issues of sexual contact with a minor usually address the age to determine the severity of the crime. If this question revolves around a particular incident, you would be best advised to talk to an attorney specifically about that situation.
