Legal Question in Criminal Law in Florida
Shoplifting
I walked out of a store in the mall and forgot I had two small items in my hand which I wasn't trying to conceal. I was charged with misdemeanor shoplifting, under $100. I'm 62 years old and this is the first time I've been charged with a crime. Question, should I go to court and pay the fines or get an attorney to represent me? I have limited amount of money for an attorney.

One option is to go to court and ask for the pre-trial diversion. That is sort of like probation, only if you complete the program, the charges will be dropped. You may have to pay some costs, and attend some classes, but the benefit of that is you can do it yourself without having to hire a lawyer. If they do not offer the pre-trial diversion, then it might be advisable to retain an attorney. You should not be forced to plead to something simply because you cannot afford to defend yourself.

It's always a good idea to get an attorney anytime you are facing prosecution for a crime.
After all, the prosecutor is an attorney who is representing the government, wouldn't you want one representing your interests?
At the same time this is not a real serious crime and because you have no criminal history, you are not looking at a jail sentence.
I am not sure if this would affect your current employment situation or employment down the road, but it's something to think about.
The cost for an attorney on this type of case should not be that much money, in my mind a reasonable fee for the piece of mind that it will give you through the process.
