Legal Question in Criminal Law in Florida

Simple Battery NTA

A friend of mine was handcuffed at a restaraunt and charged with simple battery. A drunk lady kept harrassing him and he eventually pushed her out the door - then she called the police - after the owner of the restraunt asked her to leave as well.

He has never been arrested before and they only gave him a notice to appear, there was no arrest.

What will realistically happen to him?

Re: Simple Battery NTA

If your friend has no prior criminal history he will probably be looking at a probationary sentence, assuming the State even files the charge. If the State does file the charge, he may want to consider a diversionary program like pretrial intervention (if your local state attorney's office offers "PTI"). The advantage to PTI is that his case will get dismissed at the end of his probationary period and he will not have a criminal record or conviction.
