Legal Question in Criminal Law in Florida
I have a situation where an individual called me up claiming that this is to serve notice that I will have to felony check Fraud notices filed against me in the State of Florida, because I refused to respond to some notices they claim to have sent to me. They claim in 2010 that I was involved with 2 bad checks in St. Petersburg, Fl which I have never been and know anything about. They would not tell me how much the check were for. They had the last 4 digits of my Social Security Number. But they could not actually tell me any addresses I lived at in Fl. I no longer live in Florida. They were claiming that they were from a law firm. I think my identity was stolen. I guess the question I have is how should I approach this. I want to make it clear I did not pass bad checks in St. Petersburg, Fl. And I am willing to fight this, I just need to know how.
1 Answer from Attorneys
A law firm can not file criminal charges against you. If this call came from the office of Bernie McCabe State Attorney for the 6th Judicial Circuit (st. pete) then you would be wise to follow up with them. If it came from anywhere else it is either a debt collector or possibly a scam.
