my son is 23 and being accused of touching a 15 year old that he was in a close relationship with this supposed happened in ohio where the girl lives but he lives in florida does he have to move back to ohio

That would certainly be illegal in Florida. However, Ohio law would control, so you need to contact an attorney there.
