Legal Question in Criminal Law in Florida

My son, 19 was addicted to oxycotin. After being layed off from his job and needing more pills, the lady he got the pills from offered to give him 10 pills if he filled a prescription for 200 pills. She got the script in my sons name, he filled it, gave her the pills and she paid him in pills. 3 months later and after we got him off the drug and through the withdrawals. he was arrested for using a forged script and trafficking, . His father has refused to help and I am on unpaid medical leave until January and short of money. He has no choice but to go with a public defender. Could someone tell me what probable outcome of this will be and how I should help him prepare his case? he has never been in any trouble before.

This is a very, very common situation in the Tampa Bay and Pinellas County area. My office routinely handles these types of cases (whether they are Trafficking in Oxycodone or Obtaining a Controlled Substance by Fraud or Doctor Shopping).

A lot of time an attorney can convince the State Attorney's Office to close up the Trafficking charge (which probably has a 3, 15 or 25 year minimum/mandatory prison sentence -- depending on the overall weight of the pills) and proceed only on the Obtaining a C.S. by Fraud.

It will be helpful that he's never been in trouble before. It also helps that he is under 21 years of age as the Judge can offer him a "Youthful Offender" sentence (to get around the min/man prison sentence) even if the State Attorney's Office is not in agreement.
