Legal Question in Criminal Law in Florida

My son was arrested for pawning a TV and blue ray that he was renting, what I would like to know is, if he sits in jail till his court date will he get time served and probation, he has no feliony convictions, he is 21 years old, or is he looking at prison time, I was told by him that if we bail him out, he would just get probation, I have never heard of such a thing. Thank you very much John

The short answer to you question is that it depends on many different factors that you haven't provided. Even though he has no prior felonies, his misdemeanor history, if any could affect his offers, and so could the particular facts of his case.

It is also possible that there may be legal issues in his case, such as illegal search, failure to read Miranda...etc. that could affect the outcome of his case. Depending on the facts and evidence, he may also consider taking the case to trial.

Regardless, it is important for him to at least seek some advice so that he can preserve his record of no felonies and stay out of prison.
