My son asconded from a court ordered drug rehab, he was arrested after not having ID and lying about his name and birthdate, he has been on the run for 5 yrs. he has been drug free and has worked steady for all this time, under an assumed name. He has developed relationships and been caretaker for his Girlfriend that was diagnosed with Rheaumatoid arthritis, he was on 13 yrs probation with a 15 year suspended sentence, are the any chances that he could be reinstated at all?? He asconded when he was caught with a ciggarette in an establishment with no smoking rules and the person on duty that night threatened to gather his belongings and send him back to prison he was terrified and walked away. While there he recieved his GED and had no infractions while in treatment. What do you think the odds are that he will serve time?

The odds are very good that he will server time. You don't say what the charge was but if a person has a suspended sentence, then the judge will usually sentence that person, which in this case will be 15 years prison. The fact that it has been 5 years will work against him since it will show the judge that he is not taking responsibility. It is not hopeless though since it appears he has made a turnaround. He needs an attorney immediately.
