Legal Question in Criminal Law in Florida
My son has been charged with trafficking oxycodone in St Lucie Co. Florida. He has not been to court yet, but his lawyer has said a plea has been offered. Eight years in jail and five years probation. All I want to know is what would the minimum sentence be without the plea.

It depends on the amount but it could be three years or 15 years minimum mandatory unless the prosecutor waives the minimum. In other words, the state may be offering a deal of 8 years by waiving the mandatory minimum. Or it could be that he scores that high. Or it could be that is the best deal they're offering and if he doesn't like it then he can go to trial and take his chances. Ask his attorney what the minimum would be if he goes to trial.
