Legal Question in Criminal Law in Florida
My son took a deal for 7 years of jail time and no probation, If the judge grants a mitigated sentence can she go above the total of 7 years with jail time and probation ?
Example: if she were to reduce it to five years of jail time can she go above 2 years of probation ( over 2 years would be more than the 7 year deal he signed )

Yes, the judge could because probation is considered a privilege and therefore, the judge could decide less jail time and more probation.
