Legal Question in Criminal Law in Florida

My son is currently facing charges for trafficking...3yr minimum. He is 24 with no extensive crimminal history. His first Public Defender asked he be reassigned to a different lawyer because he was defending two other people connected to the same case. The 2nd lawyer was hard to meet with and she never did any work on his case. She wanted him to agree to become an informant with the possiblity of still serving some prison time..didn't seem like a good offer. So we asked for more time to get a private lawyer but we just can't afford one. Which puts us in this delimma. Is it possible to meet with the Judge overseeing his to review his record and give us hopefuly a better option than whats been offiered. My son did wrong but he does not belong in a prison. What can we do??

In cases where a person is facing a 3 year minimum mandatory sentence judges rarely will offer anything lower, regardless of the circumstances. In your son's case it seems that his only redemption is his previously clean criminal record. Additionally, if a judge does deviate from the minimum mandatory sentence, they will still impose at least one year in jail or prison. This also goes for becoming a cooperating witness, where if he would agree to cooperate the state would waive the mandatory sentence in exchange. His age is also unfortunate because he is too old to be accepted into a bootcamp program.

If the jail time is too much for him, he can file a motion and try to suppress any of the evidence. I would have to look at the arrest reports to determine what if any viable motions can be filed; maybe the police entered without proper consent or warrant, maybe any consent was coerced. There are many constitutional issues that would need going over.
