Legal Question in Criminal Law in Florida
I spent 1 year in Missouri Jail waiting for my court date. Once I saw the judge, I was released and sent to probation for non aggregated mistaminer. After a couple of months I fled the country. I would like to go back to the US and see my kids. I was a legal resident of the US and now my residency has expired. Its now been 7 years since the incident.
Is there a statue of limitations?
1 Answer from Attorneys
I can't answer for any Missouri statute of limitations but since you posted this in Florida, I can answer as to that. Once you leave the jurisdiction of Florida, the statute of limitations is tolled. So it won't start running again until you return to Florida. You will probably be arrested for the outstanding warrant upon returning to the US regardless of where you enter. You said this was a misdemeanor. You can probably resolve this without having to come back. Contact an attorney in the area where the offense occurred and talk to them about doing this option.
