Legal Question in Criminal Law in Florida

My spouse has damaged the home during a temper tantrum, broke furniture, lights, all while waving a butcher knife. dented my vehical (however the vehical in my spouses name) is making threats to destroy the house, set it on fire (with adult children in the home). Im told until the home is set on fire there is not much I can do. How do I protect myself, home and family??

A temper tantrum is one thing, but waving a knife is assault with a deadly weapon. You need to seek out an injunction to protect yourself, your home, and your family. Do it now before someone gets hurt.

You can ask for an injunction. A permanent injunction will only occur after a hearing where you can explain to a Judge what has transpired. If granted, your spouse will have to leave the home and there can be other conditions such as anger management classes.
