Can the state (Florida) withhold pending new charges from a prisoner's attorney while that prisoner is currently incarcerated on a previous conviction until his release?

The prisoner's attorney has nothing to do with it. If the state doesn't want to file charges until after his release, they can do so, so long as it is within the statute of limitations.
