Legal Question in Criminal Law in Florida
statue 775.087(2)
I would like to know if 775.087(2) is the right statue to sentence someone under if they are a convicted felon that pawned a gun, the weapon was not used in the commision of a crime, it was just pawned in 1999 to pay child support.

a felon may not possess a firearm under any circumstances, even to sell. i had a client who removed a gun from a school yard and he was convicted. the sentence is a mandatory three years with no gain time.
