Statutory Rape/Child Custody

My girlfriend was 17 when she got pregnant with our son and I was 21. She has now decided to move out and take our son. I am afraid if I try to fight for custody, her family will charge me with statutory rape. Is this possible?

Not in Florida. The age is under 16 unless a person stands in a position of familial or custodial authority. Then the age is 18.
