Stealing Tomatoes

I got stupid with my friend and opened an unlocked semi tractor trailer of Italian bulk food and took a case of tomatoes and put it in my car. The police caught us and arrested us for 3rd degree felony burglary of an automobile. Other than misdemeanor possesion of marijuana (adjud withheld) from 8 years ago, I have a clean record. What do you think the state will do to me, especially if the trucking company doesn't press charges? Should I go with a public defender or hire an attorney? I don't want anything on my record, even a misdemeanor. Thanks

Some counties have a deferred prosecution or pre-trial intervention program. You sound like a good candidate for such a programm, but entry into such a program is entirely up to the state attorney. A private lawyer will likely have more time to devote to explaining to the state why it should allow you to partipate in the program if it is available. Good luck.
